NOTICE OF SALE

Jonathan Gilmer a/k/a Jonathan EugeneGilmer and Ailene Gilmer a/k/a Florence Ailene Gilmer a/k/a Aileen Gilmer a/k/a Arleen Gilmer and South Carolina  (Non-Jury)Department of Motor Vehicles, Mortgage Foreclosure Defendants.

Pursuant to the terms of the Master’s Order of Foreclosure and Sale granted in the above entitled case, I will sell on the next sales day, the same being Tuesday, December 04, 2018,during the usual hours of public sale, before me, in the Anderson County Courthouse, 100 South Main Street, Anderson, South Carolina, to the highest bidder, for cash, the below-described property: All that certain piece, parcel or lot of land, with all improvements thereon, situate, lying and being in the State of South Carolina, County of Anderson, Varennes Township, being more fully shown and designated as Lot 3A, containing 1.00 acre, more or less, on a plat made by William H. Campbell, Jr., RLS #9755, dated September 25, 2013, which plat is of record in the Office of the Register of Deeds for Anderson County, South Carolina in Plat Book/Slide S2050 at Page 6, said lot of land having the metes, bounds, courses and distances as appear on said plat which is incorporated herein by reference thereto and made a part hereof. Also, including a 1998 South SL6026 mobile home, Serial No. DSDAL3081AB TMS: 101-01-01-003 This being the same property conveyed unto Jonathan Gilmer and Ailene Gilmer by deed of My Properties, LLC dated October 1, 2013, and recorded October 2, 2013, in Record Book 11133 at Page 188 in the Anderson County, SC Register of Deeds.

TERMS OF SALE:  The successful bidder, other than the plaintiff, will deposit with the Master-in-Equity at conclusion of the bidding, five percent (5%) of the bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff's debt in the case of non-compliance. If the Plaintiff’s representative is not in attendance at the scheduled time of the sale, the sale shall be canceled and the property sold on some subsequent sales day after due advertisement.  Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within ten (10) days, the Master-in-Equity may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder).

As a deficiency judgment has been demanded, the bidding will remain open thirty (30) days after the date of sale. Purchaser to pay for preparation of deed, documentary stamps on the deed, and recording of the deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of Seven and a Half percent (7.5%) per annum. Subject to assessments, Anderson County taxes, easements, easements and restrictions of record, and other senior encumbrances. The Plaintiff does not warrant its title search to purchasers at foreclosure sale or other third parties, who should have their own title search performed on the subject property.
